ATV/WALKING TRAIL USE

 

Mr. David Faigin, owner of one of the properties that the trail passes through, has consulted his attorney and, because of repeated use of the trail by vehicles other than ATV’s and foot traffic, has notified MIR that he will be closing the trail to all ingress and egress. 

 The MIR board has taken the following actions to try and comply with Mr. Faigin’s wishes.

 -Started proceedings to remove a board member from the board who has violated the agreement by driving a truck on the trail.

 -Mark Hopkins will physically narrow the trail to a width to allow only ATVs to pass through.

 -This posting on the MIR website to alert all property owners to use the trail in a manner compliant  with the trail agreement we have with Mr. Faigin and to do all possible to encourage anybody encountered on the trail in a vehicle to leave immediately.

  IF YOU VALUE USE OF THIS TRAIL FOR YOURSELF OR OTHERS STAY OFF OF IT IN VEHICLES.

 

 

I will be severely

I will be severely disappointed if only one board member is removed for this. Either every board member who drove the trail should be removed, or none.

I will be equally disappointed if just the one is removed... And the entire board does NOT eventually recieve a disband order from a judge, resulting from a lawsuit over the removal of just one board member...

Either issue warnings, and leave people alone, or be equanimous in the application of removal for cause.

Are all board members who drove on trail being removed...

...from the board, or is only one being targeted? I keep hearing one name but I walked down the trail one morning followed by a board member I have yet to hear mentioned, who was driving his full size vehicle down the trail. He even got stuck on the rock for a short time before he was completely off the trail. Hmmm....I wonder if he will fess up or allow the one person to go down for a deed he, himself, also committed...? After all, this person I am referring to would also have to vote on whether or not to keep this other member around right? Or, something to that effect?
